If you paid more then one month of the 175 after you moved out, then that was too much. Just as a month to month works, you should do the right thing and give them a months notice. Nevermind how they didn't care about you being on the lease, that makes no difference now. As long as you continue to pay your part, there is no incentive for them to find a new roommate. If they did not look for a roommate or cannot prove that they did, eg: newpaper ad receipt, they have no basis to sue you. I hope you learned your lesson about signing something without disinterested advice in the future. So i need true legal advice and this is about houseing contracts and signing.?
Yes, they can take you to small claims. You cannot live somewhere for free. Even IF they forget to put you on the lease. Also, you signed something stating you would help mitigate their losses by paying $175 til they found a new roommate. Doesn't matter if it was written on toilet paper, it is considered a contract between you and the ex roommates.
Since we have no idea what it was that you signed how can we really give you a idea of what you are faced with.

If it was a promissory note it is good as gold in court. Without a 30 day notice to move they have you by the short hairs.

Since you had paid it becomes a month to month contract. Not a lease with the apartment complex. But the month to month is with the roommates. Now you need to send a certified letter stating your move out and be sure to add when you moved out as a date. And have that verified by where you live now. Best of luck
The girls have a case..you signed, not a lease, you signed a promissory note and they were smart to get that.

However...a judge is only going to award them one -month of rent.

People seem to think that they have no legal obligations if they don't sign a lease that it would be a free-for-all to walk away whenever they wanted...not true.

When you write the first check you created a 30 -day contract.

So if you gave no notice, you owe for the month that you were there, plus ONE month (for a 30 day notice that you probably didn't give) and that is all a judge will award her.
