Anyone got some legal advice?

hi everyone. i shared my flat with another person. she wasnt a nice person and destroyed my flat. she then got a solicitor with legal funding and tried to sue me for the return of her deposit. she didnt show up at court and her claim was thrown out. at the time i was counterclaiming (using a solicitor) for the damage she caused. our cliam and costs were adjourned generally. since the court case i've receieved a bill from my solicitor for 拢3000. i work and didnt qualify for legal aid. can i go back to the court and ask for some money from public funds and how do i do this? many thanksAnyone got some legal advice?
You can go back to Court and ask for the Other Party be Held Responsible for the Court Costs and the Cost of Legal Fees to Collect it. That should have been Requested at the Beginning! The Judge would have Ordered it along with any other damages.Anyone got some legal advice?

I'm afraid you can't go back to court to re-open a case that has been ajourned, which in this case is. The only way it would escalate to court again would be if you were not to pay the bill.


At that point it becomes a debt issue.





What you need to do is go down to your local CAB (Citizens Advice Bureau) and set up a debt management programme. This safe gaurds your credit profile and technically you are paying off the bill, just slower.


At this point you can discuss your case in more depth with your case worker and he/she will advise you from that point.

Unless I have missed something with this question if you paid a solictor for work then it cannot be reclaimed. This financial burden you will have to accept.





If the case was thrown out did the judge order costs in your case? The usual rule of thumb is that ';costs follow the event';. That is the loser pays the winner plus any associated costs. Even though it may have been adjourned you still have the legal right to sue her for any damages and associated costs to you.
You have spent 拢3000 trying to sue someone who has no money. I am missing something here or is that not a blatant waste of time and money?





If she was guilty of criminal damage then how did she get legal aid? If not why didn't you claim on your insurance for the damage?





Try the CAB see if they can advise you more. They at least won't charge you anything.
