I had to defend myself which cost me roughly $50,000 dollars besides all the emotional trauma. I have had to file bancruptcy only to find out when trial was over there was no evidence. The psychiatrist that was on the stand to speak, lied, and i have the documents to prove it. He also violated HIPPA Laws which the Federal Government will do nothing about since they have a 3 month rule on reporting. This doctor almost ruined my life and now the Judge has in my divorce decree that I must continue counseling for my mental disorder. This is all public record. It is slander at its worse.I need some legal advice. I was falsely accused of a mental illness in a child custody case.?
Get a lawyer. That is your best bet.
Can't afford one, then call your state's BAR assoc., and they can hook you up with someone that will work on a payment plan, at a discounted rate, or pro bono (free).I need some legal advice. I was falsely accused of a mental illness in a child custody case.?
If this is all true, then you need a good lawyer. After the custody case, I'd sue the shrink for malpractice.
Get a lawyer probably your only chance.
well first off...if you had an atty he should have had you see a qualified mental health expert to have you checked out. he should have also had some exxpert witnesses to discredit the other professional opinion. he should have cross examoned him about whether he had ever treated you or had sessions with you, he should have asked if he was being paid to testify, and how many times he testified without actually examining the ';patient'; this would have all been to discredit him. if you had an attorney and he did not try to disprove the accusations you should make a complaint to the bar association in your state.
if the ex's attorney filed in discovery for you to produced medical records and you did not object as to priviledge then that was also a no no on your atty's part. if this was an order based on a request for mental and or physical evaluation then its a different story.
if the trial was recent i would look into state law regarding new trial and appeals deadlines and begin over again if still possible. this may help to change the current order if new trial is granted
