I crashed into someone's car and broke the windshield on the back. I was not driving, I was on my bike. And the car was parked on the side of the road and there was no one inside. I didn't do this on purpose of course. Then I called the ambulance and the police came as well. Later, I got a call from the car's owner's insurance company telling me to pay for the damage. Instead of paying money, can I offer to repair the car at an auto shop? Because getting a repair at an auto shop cost less than the actually damage payment. Or do I absolutely have to pay for the damage?
In case that the owner has already repair the window, can I ask for the receipt of the repair and just pay that amount?
What are the legal process for that? Do I have to go to court? I need some legal advice on property damage.?
You ran into a stationary object and damaged it, so you are going to be liable for the damages. What you are doing now is negotiating. You two can negotiate any sort of settlement to which you both agree. Be sure he signs a release of claims once you reach an agreement.I need some legal advice on property damage.?
Sorry about your accident first off, hope you are ok physically because I know that must of hurt on a bike to break a windsheild.
Unfortunately, the owners of the car have their choice on where to repair it. You can try asking them to have it repaired where you want them too, but they arent obligated to do so...and I would want my own car repaired at the place I chose too, no offense.
I would just pay for the damage, and you can ask for a reciept for the window repair, as well as any other reciepts for work they had done. I would call them up and appologize to them and let them know you are trying your damndest to make things right, ask about making payments to them. Your honesty and dedication may make them want to help you out as well. If not, worse case scenario is you just pay for the damage.
You have to pay the insurance damages and he can take it to the dealer if he wants. You'd have to file a suit and have it overturned in court. I would really try to go to them and try to come up with an agreement, most people will.
ask to see the repair bill but first go around to repair shops and get a price before you begin, that way you will have an idea as to a ball park figure of the repair and the cars owner won't be able to rip you off, no lawyer is needed, depending on the make and year, figure around 600.00, give or take.
