Alright before I start...please please please please NO lectures or terrible comments on how I'm a bad person...
So a year and a half ago (age 17) I, along with many other people, were charged with underage consumption of alcohol. This was the first time I have EVER gotten in trouble with anything in my entire life. I was on honor roll all through high school, I don't do drugs....I was just a high school stupid making a stupid mistake. Anyways, in the state of VA, if you are charged with underage consumption, posession, etc...your license is automatically taken away whether it is a driving offense or not. So I paid the consequences...6 month license suspension, 50hrs of comm service, and attend 10 classes of vasap...all for a sip of alcohol..but hey if I finished this it would be completely removed from my record when I turned 18.
In addition too my requirements, I was placed under advisement for a year. Well this happened last June 2008.
In May 2009, I received my first speeding ticket...i know there is no excuses but if I was on my lunch hr at school and needed to run home and get a homework assignment I left at home...it was due that day...i was running late so I speeded yadda yadda...so yeah a speeding ticker =/
SO i paid the fine and since I was still 17 I had to attend a driving improvement class for a saturday (required by state law to attend if you receive a ticket under 18).
So then I get a summons yesterday...totally suprised me...and I have to appear in court in about three weeks basically because I got a speeding ticket while under advisement.
I just want this to go AWAY...I paid all the consequences for my pending charge and the ticket..now I gotta go back to get a slap on the hand by the judge. I have spoken to 2 lawyers today...ONE said that he doesn't think he can do anything with my license because I'm 18 now...the worst he can do is keep the my previous charge on my juvenile record.
The other lawyer said he could possibly restrict my license seeing as the agreement to stay out of trouble for an entire year was made when I was a minor and I violated that with a speeding ticket.
SO IM SO CONFUSED. I have 2 stories here and the bottom line is I am terri-terri-TERRIFIED my license is in jeopardy. I commute to college every day (20min) I take 16 credit hours to get into a nursing program and I work full time and I travel every weekend to visit family/boyfriend...singing lessons etc.
I know it depends on the state but from maybe your previous experiences or stories you heard, what do you think could happen? Any insight? I'm hearing 2 different answers from 2 different lawyers that are both charging the same price. Idk who to hire or who to believe.
ALSO once again please spare me the lectures...I've paid for this like you wouldn't believe and I accepted it and did everything I was supposed to. I'm no where near a trouble maker although it looks like it on YA simply because you don't know me. I was young hs student who made a mistake and learned from it...now I'm continuing to pay for it a yr and a half later.
Just please offer any insight you can....
Thank you to everyone who doesn't judge =)I NEED LEGAL ADVICE...or atleast some insight. What's gonna happen? Who to believe? (It's long..sorry)?
Sadly Laura yo are going to face the music not in a bad way. Now I'm no expert or any thing but when you get in front of the judge bring all supporting documents with you. I hope you at least get a chance to speak in your behalf, or at least speak to the DA who is there. Only can go by what you have said here not knowing of any other underlining things going o face value.
Most HS kids will and do some crazy stuff oops it is a lesson well learned, you was doing good until you had to hurry for a homework stuff and got caught it happens. What has taken place to the others that you was hanging with when you took that sip? Your grades remained up after the sip? The ticket came about before probation was done. It was as a juve and most times those record's are sealed maybe the courts have access but the common man does not. Hopefully you will only have to stand for the ticket.
Not sure if you can put yourself at the mercy of the court or not, there is also such a thing as prayer of judgment. Here in NC you can only have one of those in a three year period. If they give you that you will have to really keep your nose clean.
Good luck in the Nursing program. My wife has been one now over 13 years. she enjoys it, many of he jobs are not always very glamorous you will have to get dirty. Spinal cord rehab.Smell the flowers and blow out the candles.I NEED LEGAL ADVICE...or atleast some insight. What's gonna happen? Who to believe? (It's long..sorry)?
First off no one should judge you because they dont know you;) anyways i am 20 yrs old and i have recieved one also when i was 18 your young and tell me what high school teenager isnt out there drinking lol. But, i can tell you the state your in seems real strict in GA i got only a 542$ ticket and just watched a video in class. However, you said you were on advisement i am guessing you mean supervised probation. Did the officer just give u a speeding ticket or did he give u a speeding ticket, and violation of probation?? I am not sure about the outcome but make sure the judge knows that you are in college and working that helps and ask him if there is anything you can do to keep your license becuz u dont want it to affect your job/school. Im sure u will be ok I hope this helps you and everyone makes mistakes keep your head up high. If you need any advice feel free to email me at christopher.whitehead13@yahoo.com and i can help you.
