HELP--APARTMENT LIVING??? LEGAL ADVICE PLEASE!!!?

My family of three have been residing in our new apartment now for two months.(HUSBAND%26lt; MYSELF AND SEVEN YEAR OLD)


WE ARE GOOD NEIGHBORS... WE ARE NOT LOUD OR RUDE.


WE DO HOWEVER LIVE WITH RUDE/ LOUD Neighbors.


Our apartment complex recently issued a warning saying ';we're loud at night';.


WE SLEEP EVERYNIGHT AT 10:00pm


WE GET UP IN THE MORNING FOR WORK at 5:00am.


SO WE HAVE TO SLEEP EARLY.


SO WHAT DO I DO?


How do i prove we're not loud/???


The manager said'; IT WAS ONLY A WARNING';


So if we're not loud-- dont worry about it';


BUT we're not loud to begin with...


Should i get some fellow neighbors,to write a statement to say we're not loud????

This question slays me. You're going to such lengths to demonstrate that you're not making noise, but TYPING IN CAPS TO THAT EXTENT IS GENERALLY SEEN AS ';SHOUTING';, OR ATTEMPTING TO BE ';LOUD'; AND RUDE.





You don't need to prove that you're not loud. You were given a verbal warning, you contested it, it's over. Getting your neighbors to write a statement saying you're not loud makes you look like somebody who has something to feel guilty about, something to hide, or somebody with a persecution complex of some sort, if not all of the above. It's overboard, and overreactions scream ';look at me, I'm a problem tenant waiting to happen!'; (especially true of people who portray themselves as saints, while talking about how the neighbors are all loud and rude!). It also does NOTHING to prove that you're not loud.





The people above you aren't going to hear the things the folks below you do, the people across the hall aren't going to be as effected as those immediately next door -- and the impact on those directly next door is going to vary, depending on your location in your apartment, and where they are in theirs.





If it's an older building, the soundproofing leaves a lot to be desired, and things are probably more audible than you'd think they'd be, even if you don't realize the noise. You may want to talk to your neighbors in a non-confrontational manner to find out IF an unreasonable level of noise is coming from your apartment, and what you can do to tone it down [it may be as simple as moving a TV or computer off of a certain wall]. File a complaint with the Housing Rights Center, they will send an investigator out and determine if there are any violation.
it appears you are not AS QUIET AS YOU THINK, be objective about ti seeing you just moved in it appears you may have to rethink what quiet means
it sounds to me like the landlord doesn't know who is being loud so he is issuing warnings to everyone. i wouldn't worry to much about it. if they try to evict you, you would go to court, have an eviction trial and the burden would be on the landlord to show that you were loud. the burden would not be on you to prove that you were not being loud. that would be hard for him to do.





seems to me like you have another problem. your neighbors are bing loud. i would complain to the landlord about your neighbors in writing. send it to your landlord via certified mail. if landlord does not fix the problem he is violating your right to quiet enjoyment of your apt and therefore your lease is invalid and you can move without any penaly/owing any more money remaining on the lease.
