Need some legal advice about my bf saling his car.?

My boyfriend sold his car to this guy that i know named Mike. He was asking 900 dollars total for the car but he said he will make it to 800 dollars and now we are letting him make a payment plan so my bf let him put 350 dollars down on it and he said he had more money coming to him weekly. The title is not in the guys name everything is still in my bfs name but they signed a agreement. My question is sense this guy is not answering his phone and pretty much not keeping in touch with us about the payment plan and the title and registraition to the car is still in my bfs name can we get it back? Need some legal advice about my bf saling his car.?
Its not stealing - you handed the car over willingly with a singed agreement for payment. The car is not stolen.





Since it is still in your name, you can reposess the car. Go to the police station and fill out the appropriate paperwork. Take an officer with you and go get the car. Make sure you take the original signed agreement with you.





If you are unable to get the car back, you have to file in small claims court. file for the balance of the loan, or the return of the car. The guy will inevitably want his $350 back, but you are not obligated to return it. He would have to sue, or counter sue, for the return of the money. Typically, he would not prevail as he had the car for a period of time and was able ot use it - it would be considered compensation for using the vehicle.Need some legal advice about my bf saling his car.?
You should never have allowed him to put money down on the car and have him drive it away.





He's not answering the phone because he's trying to avoid you, obviously. Report it to the police. But it is your fault for letting the guy drive the car away. Hopefully you can get some money back if the car is ever recovered.
Find a good repossession agency and they will handle it for you if you show them the proper paperwork. It'll probably cost around $200-$300 but its worth it when you stand to lose $700 or so if the guy keeps the car and trashes it.
